H-1B Processing Time: What to Expect at Each Stage

Review scope and corrections

This review checks the guide's rule statements against the listed official sources and its data descriptions against the queries. It does not verify an individual case. Archive refresh dates describe ingestion, not a rule review.

Separated LCA calendar-day observations from USCIS estimates and premium-processing business days. Clarified action deadlines, evidence requests, fees, and consular waits.

USCIS interactive tools and some disclosure downloads did not return a usable response during this review. Use the official tools for current case status and processing estimates.

H-1B processing has separate stages. DOL describes a usual seven-working-day LCA review. Regular USCIS petition times vary by category and office. Premium processing requires an action within 15 business days, subject to its rules; it does not guarantee approval or finish consular processing.[1][2][3][4]

The record's clock

How fast does certification actually run?

6 days

Median 6 calendar days from LCA submission to decision (8,089,866 certified records; 90th percentile 7). This aggregate includes all stored LCA visa classes and available years with both dates. It does not measure USCIS petition time.

15 business days

Premium processing ($2,965) requires USCIS action within 15 business days for an eligible H-1B petition. An RFE or notice of intent stops the clock; a response starts a new full clock. Fraud or misrepresentation investigations have a separate exception. It does not guarantee approval.[5]

The five stages

The five clocks, stage by stage

LCA certification (DOL)

Usually 7 working days

DOL reviews the LCA for completeness and obvious inaccuracies. The regulation says it usually decides certification within seven working days. This is not a promise to certify the filing or a payroll audit.

Pauses
An incomplete or obviously inaccurate filing can be denied. Read the DOL result before correcting or refiling.
Check
flag.dol.gov publishes the LCA process; this site's record shows real certification times.

Lottery to selection (cap cases)

Check the announced season

For cap-subject cases, USCIS announces registration and petition filing windows. Selection uses wage-level weighting from FY2027. A selection notice permits a petition filing; it is not approval.[6][7]

Pauses
Season dates and any later selection rounds depend on USCIS announcements.
Check
USCIS announces selection completion each spring on uscis.gov.

Petition adjudication (regular)

Check the current USCIS tool

Service times vary by category and caseload. Use the current USCIS tool and read the measure it gives. The current tool normally reports the time to complete 80% of recent cases; historical national tables report medians.[8]

Pauses
The RFE notice states the response deadline, up to 12 weeks. Premium-processing time stops and restarts when USCIS receives the response. Regular processing has no equivalent guaranteed action clock.[9]
Check
In the USCIS processing-time tool, select Form I-129, the relevant category, and the listed office or Service Center Operations option.

Petition adjudication (premium, optional)

15 business days

$2,965 for requests postmarked on or after March 1, 2026 ($2,805 before) buys a 15-business-day action clock: approval, denial, RFE, or notice of intent. If USCIS misses the clock, it normally refunds the fee and continues. The regulation has a separate exception for fraud or misrepresentation investigations.

Pauses
The 15-day clock stops when an RFE issues and restarts when USCIS receives the response.
Check
The premium page on uscis.gov carries the current fee and window.

Visa stamp (consulate, from abroad)

Check the consulate’s current guidance

A worker abroad needs any required visa before seeking H-1B admission. An interview may be required. Consular processing has a separate timeline from USCIS petition review.

Pauses
A refusal under INA 221(g) can require more evidence or administrative processing. Interview-wait figures do not include that processing time.[10]
Check
travel.state.gov publishes interview-wait times per consulate.

FAQ

H-1B processing time FAQ

H-1B processing time FAQ

What is the current H-1B processing time?

There is no single H-1B processing time. Check the current USCIS tool for the petition category and office. DOL describes a usual seven-working-day LCA review. Premium processing requires action within 15 business days, subject to its rules. It does not guarantee approval or finish consular processing.

Does premium processing speed up the whole thing?

Premium processing covers USCIS action on the petition. LCA review, evidence preparation, and any consular step keep their own clocks. An eligible H-1B worker can start new employment when a qualifying petition is properly filed or on its requested start date, whichever is later. Portability conditions still apply.[12]

How long does an RFE add?

The RFE notice states the response deadline. The regulation permits up to 12 weeks for a response. Total time depends on the response and adjudication. For premium processing, the action clock restarts when USCIS receives the response. DOL LCA disclosure files do not report USCIS RFEs.

How fast is the LCA step?

DOL reviews completeness and obvious inaccuracies. The regulation describes a usual seven-working-day certification decision, not a guarantee of approval. Our timing figure measures calendar-day submission-to-decision lags across stored LCA programs and years; it does not measure USCIS processing.

Can you track a case in the public data?

This site does not track individual USCIS petition status. DOL disclosure files show LCA filing and decision dates, offered wages, employers, and LCA outcomes. USCIS petition processing, RFEs, and employer-specific petition denial rates are separate records.
